Abdul Hamid J: In the circumstances, I am of the view that the failure on the part of the defendants to supply a furnace which would meet the required temperature, constituted a breach of the condition of the contract entitling the plaintiffs to treat such breach as a breach of warranty. For the reasons which I have stated above, it is my judgment that the defendants are liable for the breach of the condition of the agreement and the plaintiffs clai m should therefore succeed. The Federal Court said that it is true that the amount awarded in this case was merely conjectural but there was at least some evidence before the court which might support the award. It is because that the case fell within the provisions of s 74(1) of the Contracts (Malay States) Ordinance, that is, when damages arising were such as might reasonably be supposed to have been in the contemplation of both parties at the time they made the contract, as the probable result of the breach of it. This is indeed the principle in Hadley v Baxendale (1854) . Case: Aruna Mills Ltd v Dhanrajmal Gobindram [1968] In Aruna Mills Ltd v Dhanrajmal Gobindram2, goods were to be shipped from India and the contract expressly stated that the buyers would take the risk of any devaluation of the rupee. The rupee was devalued and the price payable by the buyers was increased accordingly. However, a portion of that increase arose as a result of late shipment by the sellers, and it was held that the resultant loss could be recovered by the buyers. The ââ¬Ëdevaluationââ¬â¢ clause demonstrated that the parties had turned their minds to the impact of exchange losses. Lord Reid observed: ââ¬Å"I am satisfied that the court [in Hadley v Baxendale] did not intend that every type of damage which was reasonably foreseeable by the parties when the contract was made should either be considered as arising naturally, in the usual course of things, or be supposed to have been in the contemplation of the parties. Indeed the decision makes it clear that a type of damage which was plainly foreseeable as a real possibility but which would only occur in a small minority of cases cannot be regarded as arising in the usual course of things or be supposed to have been in the contemplation of the parties: the parties are not supposed to contemplate as grounds for the recovery of damage any type of loss or damage which on the knowledge available to the defendant would appear to him as only likely to occur in a small minority of cases. In cases like Hadley v Baxendale or the present case it is not enough that in fact the plaintiffââ¬â¢s loss was directly caused by the defendantââ¬â¢s breach of contract. It clearly was so caused in both. The crucial question is whether, on the information available to the defendant when the contract was made, he should, or the reasonable man in his position would, have realized that such loss was sufficiently likely to result from the breach of contract to make it proper to hold that the loss flowed naturally from the breach or that loss of that kind should have been within his contemplation. Here, Lord Reid saw the law as applying an objective test, and one which reflects the realities of the business transaction entered into by the contracting parties. In the light of the decision of our court the law on remoteness of damage in contract is therefore as laid down in Hadley v Baxendale (1854) and restated in Victoria Laundry [1949] s 74 which provides that compensation is not to be given for any remote or indirect loss sustained is superfluous in view of the limits. Case: Tan Chin Kim Sawmill Factory Sdn Bhd v Lindeteves-Jacoberg (M) Sdn Bhd3 [1982] In Tan Chin Kim Sawmill, it is clear from these three clauses and from the terms contained in MIMBââ¬â¢s letter dated 2 June 1975, which terms were accepted by both the appellant and the respondent that the intention of the parties was that MIMB was to be compensated not only for all sums of money which would become due and payable by the appellant but also for ââ¬Å"all losses, damages costs and expensesâ⬠suffered by MIMB. The letter and these three clauses by stipulating that sums other than rentals due are recoverable therefore make the financing case inapplicable to the case under the present appeal, and as such the amount of $527,039. 37 which the respondent paid as a cash price settlement for the equipment on 11 February 1977 was in fact the amount which the appellant itself was bound to pay under the lease agreement. In fact the appellant was informed of this fact by MIMB in its letter to the appellant dated 22 March 1976 and the respondent was offered back the equipment on the stated cash price settlement only in the event that the appellant was unable to pay MIMB the said cash price settlement by 1 April 1976. Abdoolcader J:à In the circumstances on a consideration of the evidence adduced both oral and documentary and for the reasons I have stated, I find no substance whatsoever in the contention of the plaintiffs that the first plaintiff was at any time the owner of the machinery in question or that the arrangement entered into to provide finance to the first plaintiff was otherwise than what the documents produced tales quales show it to be, namely, the provision of lease financing to the first plaintiff by the second defendant by way of a lease of the machinery to the former by the latter which had purchased it from the first defendant. The crux of the plaintiffs claim to the effect that the documents are a sham because they were a device to cover a transaction whereby goods were given as security for a loan must accordingly fail. Cadit quaestio, and it follows that the plaintiffs ancillary claims for damages and other relief must necessarily succumb, and it is perhaps only necessary for me to observe that in the matter of the plaintiffs claim for damages Mr. Rajah himself had to admit that the y have not satisfactorily proved every item of the damages sought. It is also ordered that the plaintiffs be entitled to damages on account of the non fulfillment of the agreement, the amount of such damages to be assessed by the senior assistant registrar. I blinked. The pencil drummed on the table erratically as my hand twitched, my knuckles feeling the trembling broken lead beneath my anxious thumb. The incessant tapping fell dull on my ears, but I earned more than one icy glance from classmates. The paper stared back at me, white and unyielding. My eyes were locked on its blankness, but I didnââ¬â¢t see. The faint blue lines blurred, and fabricated shadows danced before my unfocused eyes. My mind whirred; I could almost hear the gears struggling fruitlessly to turn without oil. I felt my heart stretch with the effort of keeping all the unsatisfied energy within. My fingers laced up through my hair and I pulled on the long curls, as if the prickling pain would help me think. A frustrated growl threatened to escape my throat, but I pushed it back down with a silent reminder that everyone was already irritated with me. The vague babbling from behind served as an ignored cue that a friend was trying vainly to communicate with me. From experience I knew that after a moment, she would mutter, ââ¬Å"You canââ¬â¢t hear anything Iââ¬â¢m saying, can you?â⬠and give up on trying to reach me. That was fine by me. The whole of the world was a distraction; I couldnââ¬â¢t afford any individual pulls from my work. As it was, a song hummed distantly in my mind, begging me to draw it closer. My pencil adopted the beat and I frowned. I studied my hands, the tendons tense beneath the surface, knuckles jutting out sharply, and scratches splitting pale skin. Instinctively, I drew one up to my mouth and began to gnaw on an abused and ragged fingernail, feeling my braces click, metal on metal. I noticed my habit, but did nothing to stop. A thousand thousand thoughts sauntered across the surface of my sanity, mocking... ...ped a bucket of cold water over my sleeping chimera. The sound of my pencilââ¬â¢s knocking bounced off the walls of my consciousness and echoed back into my ears. Words of description flashed before my eyes, leading me on towards the light. My paperââ¬â¢s utter blankness ceased mocking me, and held promise instead of contempt. I felt the words there, written in ink only I could see, waiting, waiting for me. Occupations are important in order to be successful in life. One needs a source of income and a way to provide for oneââ¬â¢s families. Some people work at home, some people have a schedule when one leaves at a certain time each day and return home at the same time each night. One gets comfortable in oneââ¬â¢s work but does one take time to ask oneself why one is doing it? If an occupation does not help society or have any real purpose then is it really a useful occupation or is it just a bunch of mindless activity? Professional athletes make an insurmountable amount of money but what is the point of professional sports? Professional sports do not help make the world a better place nor does it have a purpose other than entertainment for the sports junkies on this earth. What is the purpose of movie makers and artists? How do they make the world a better place? In some ways they make a world a worse place because people get so caught up in entertainment that they forget about th e rest of the world and the ones who suffer and the corrupt governments and the deadly diseases. Why cant jobs be created to help in those areas? Instead of paying people for doing mindless jobs, one should be paying others to actually work to make this world a better place with a better economy and without suffering people. In George Orwellââ¬â¢s novel 1984 it offers a great view of mindless occupations. Winston, the main character talks about how boring his work is in the Ministry of Plenty. He explains how his work is to change the words and meaning in newspapers, books, letters and any other text related materials in order to make the government and the society the best that it can be. Then once he follows his orders and completely changes history with his speakwrite, he takes the original information and dumps it down a memory hole which destroys it (Orwell 37). Everything that Winston must write has to take the form of the Newspeak language which is the English language modified, and made simpler by combining words together. For example, instead of having words such as ââ¬Ëexcellentââ¬â¢ or ââ¬Ësplendidââ¬â¢ one would use the word plusgood or doubleplusgood if you wanted something even stronger (Orwell 51). Another example is Winstonââ¬â¢s workplace.

The Justice of the Peace was created to protect the colonies and keep order. Criminals were usually put in stocks in the middle of town to pay their sentence to society. Eventually towns were growing to much and turning into cities where Justice of the peace would Just not work anymore. Bros before hoeââ¬â¢s in masculinity Essay
Although there are some men that break the mold, the majority of men will never fully endorse womenââ¬â¢s equality. This is not because most men are pigs looking to degrade women, it is because of the concept of the paradox of menââ¬â¢s power. Men as a social group are powerful and yet so many men feel weak, especially in relationships with women. Women seem to have the power to put a leash on men. Many men feel in control when they have the support of their fraternity of brothers. Most men are not willing to let their brothers down by siding with pro-feminists. Siding with pro-feminists, as a male, could be seen as trying to escape from the box that is hegemonic masculinity. There has been a destabilization of hegemonic masculinity with the movement of civil rights groups, namely the womenââ¬â¢s rights movement. There are many arguments in favor of equality amongst men and women. In the past women were seen as the homemakers, that there was no need to educate them and there was clearly no place in the workforce for their sex. ââ¬Å"The time when girls needed no education, because all they had to do was to pick one of a troop of suitors, marry him, keep house for him, and live on his wages, is gone forever, for the very simple reason that no woman can consistently live on a manââ¬â¢s wages any more (Kimmel and Mosmiller, 1992: 178-179).â⬠Early in this nations history, men were viewed as the breadwinners; it was very seldom that one would see a woman in the workplace. As the years have progressed however, there has been a steady shift towards a society where just as many women are working as men. It has also become more common to see stay at home dads. By 1999, the percentage of women in the workforce was nearly sixty percent and men had fallen to about seventy-five percent according to the International Union, United Automobile, Aerospace and Agricultural Implement Workers of Americaââ¬â¢s (UAW) website. R.W. Connell states that there are many reasons why equality in the workplace would benefit men in his article ââ¬Å"Change among the Gatekeepers.â⬠ââ¬Å"For instance, very large numbers of men are fathers, and about half of their children are girls (Connell, 2005: 617).â⬠Men with daughters will clearly want their children to succeed and have the same opportunities as other children, regardless of gender. Connell also states that the role of breadwinner is a burden that many men feel compelled to fill. Over the years this has led to health concerns as a result of stress and work relatedà illness and injury. With more women in the workplace the number of men with these problems should significantly decrease. Recently there has been a surge of women in the political realm. Hillary Clinton running for president and Sarah Palin being picked, by a man, to be his vice presidential running mate shows that times have changed immensely. If a woman were to run for a position such as this early in Americaââ¬â¢s history, she would have been laughed at. The idea of a female president still is not completely accepted by everyone, but Clinton did have her share of male supporters. Connell states that men would be subject to less violence if more women were in the workplace and if they held high power positions such as governor and president (Connell, 2005: 615). People in high power positions are often targeted for acts of violence, for instance John F. Kennedy, Abraham Lincoln, and Robert Kennedy, just to name a few. It is not often that one turns on the news to hear of a female being assassinated. Menââ¬â¢s violence towards women will also be decreased(Kimmel and Mosmiller, 1992). ââ¬Å"Many pro-feminist men have embraced a feminist analysis male violence against women, particularly battery and rape (Kimmel and Mosmiller, 1992: 371).â⬠The idea is that if equality is reached in society, men and women will have more meaningful relationships thus increasing understanding of one another and decreasing hostility and aggression. ââ¬Å"In our society, caring (for children, sick people, the elderly etc.) is viewed as a ââ¬Ëwomanââ¬â¢s businessââ¬â¢. The ââ¬Ëart of caringââ¬â¢ appears almost as a natural condition of being a woman: ââ¬ËBeing a woman means being good at caring for people.ââ¬â¢ However, in many parts of the world, we are seeing more men carrying out tasks associated with child care, either inside the home or in institutions (Lyra, 2004: 3).â⬠Although many believe that women should have equal rights, there is still a sense that a womanââ¬â¢s place is in the household. These beliefs have been proliferated for centuries from the establishment of the United States. In the beginning this was how society was organized, a somewhat caste-like system. Now there has been a shift, but the ideas still remain. For example when Hillary Clinton ran for president if these issues did not still exist then the fact that she is a woman would never have been as big a talking point as it proved to be. Many men and women for that matter refused to support her simply because she was in factà a female running for president. The problem with universal equality is that one group will always be looking for an advantage over another group. ââ¬Å"An essential question for any pro-feminist man must be whether or not it is possible for men to act against their own collective material interests (Douglas, 1994: 33).â⬠As Michael Kaufman states in his idea of the paradox of menââ¬â¢s power, men as a group are powerful. For as long as this country has been in existence, men have had the certain privileges over women. This may not seem fair and to be honest it isnââ¬â¢t, but it would be interesting to turn the tables and see how women would act then. Would they be as fiercely in favor of equal rights, or would they do as many men do and just leave the system alone? This is a clear question that could easily cross the mind of any male pondering gender equality. The answer is not so cut and dry, this is why it will be difficult, even after many years, to get all men on board with the womenââ¬â¢s rights movement. ââ¬Å"The pro-feminist menââ¬â¢s movement starts from the acknowledgement that men have power and privilege in a male-dominated society (Kaufman, 1994: 156).â⬠This idea is a problem for many men, so much so that there are even Menââ¬â¢s rights activists. Not all men are willing to admit that males have an advantage over women in society. ââ¬Å"Menââ¬â¢s rights activists fight perceived menââ¬â¢s oppression, including selective service registration, unfair legal decrees of alimony and child support, and domestic violence against men (Fox, 2004: 104).â⬠A common argument that Iââ¬â¢ve heard is that women are looking for equal rights, but everyone on that side of the fence seems to be perfectly content with only allowing men to be drafted for wars. I donââ¬â¢t wish to sound like a hostile sexist because I am most definitely in favor of womenââ¬â¢s rights, I just donââ¬â¢t see it as a reality for any time in the near future. The fact of the matter is that you cant have it both ways. In order for full equality, the feminists need to take the good with the bad, otherwise it is not equality that feminists are looking for, but instead to gain the upper hand on men. I feel that many men recognize this fact and it is for this reason they shy away from supporting the feminist movement. Most of this issue lies on the idea of equality in the workplace. ââ¬Å"Let the ablest of the sex be called to the lecture room, to the temperance rostrum, and whenever a post office falls vacant and a deserving woman is competent to fill and willingly take it, let her be appointed (Greely, 1852: 167).â⬠If I am the candidate for a job and I am up against a woman, I am not going to step aside and say ââ¬Ëyou take this position because women have been oppressed for quite some time.ââ¬â¢ I, like Horace Greely, believe that the most qualified person should get the job. I know that Iââ¬â¢ve seen many women, who are clearly in favor of equal treatment, bat their eyelashes, show some cleavage, and flirt with police officers to get out of a ticket. The same thing occurs in the workplace with interviews, some women will cast aside their beliefs in order to flirt their way into a job. As an on-looking male, I must make note that these women are playing on the very stereotypes that they seek to eliminate. This makes it even more difficult for men to take up the fight for pro-feminism; if women cannot take their fight seriously, how can men be expected to join? Most men are all for women fighting for equality and many will not be completely opposed to those men who do choose to fight on the pro-feminist side. There is a sense that these men are leaving the brotherhood. Some might say that it is almost an oxymoron to be a pro-feminist man. If a complete level of equality among genders were to be reached, which I donââ¬â¢t see anytime in the near future, it would be as a result of the lowering of menââ¬â¢s rights in order to level the playing field. Many men hold this view and this is why men who choose to fight for women can be viewed as traitors in a sense. A lot of men can feel constricted by women who often use tools like sex to get what they want. It is in these times that men usually turn to their ââ¬Ëbrothers in armsââ¬â¢ to loosen the collar that women impose as a means of control. As bad as it may sound, a lot of men will be in favor of womenââ¬â¢s rights, but do nothing about it. Honestly what group with power is looking to relinquish their supremacy? The way society progresses is through competition. Most people, men and women alike, will always be looking for the upper hand.
